EQUAL PAY

Equal Pay

We are particularly committed to safeguarding the right to equal pay and the conformity of internal regulations and steps taken by employers with the EU Transparency Directive. Since this directive follows other EU directives that have been recently in force, as well as the case law of the Court of Justice of the European Union and national anti-discrimination legislation, we can draw on our in-depth expertise in this field and offer any employer our outstanding comprehensive legal services concerning equal pay for work of equal value and in preparing for the fulfillment of any requirements imposed by this directive. This preparation also includes training, which we can provide to your managers and other staff members at all levels.

Besides establishing gender-neutral criteria for determining pay, pay grades, and pay progression and assisting in deciding whether a particular type of work is of equal value, we help employers identify the reasons for gender pay gaps and develop systematic processes for reducing gender differences. At the same time, we support employers to apply gender-neutral policies to further aspects of employment relationships that contribute to the gender pay gap, for example, in connection with recruiting procedures, career advancement, and return from maternity or parental leave.

Since the directive also refers to employee representatives in many aspects of the right to equal pay, Krivak & Co. renders its full service to them.

In Slovakia, the prohibition of pay discrimination is related to a whole range of further prohibited grounds for discrimination (including not only sex and gender but also disability, sexual orientation, and ethnicity). Under Slovak law, equal pay for equal work is applicable even without reference to the prohibited grounds of discrimination. Krivak & Co. can help you address violations of the right to equal pay for equal work.

If your right to equal pay for equal work has been infringed, we will be happy to advise you on possible legal action and represent you before the labor inspectorate or court.
