Janka Debrecéniová

LEGAL EXPERT IN ANTI-DISCRIMINATION LAW AND HUMAN RIGHTS

From 2000 to 2023, I was mainly involved in the human rights association Občan, demokracia a zodpovednosť (ODZ, Citizen, Democracy and Accountability), where I was responsible for the usual legal issues connected to the operation of the ODZ as a non-government organization. I provided legal services and also participated in publication, education, and research projects focusing on anti-discrimination and equal treatment, the human rights of women and gender equality.
From 2014 to 2017 and from 2020 to 2023, I also served as a deputy to the ODZ director.

Between 2021 and 2023, I worked as an external judicial advisor at the Constitutional Court of the Slovak Republic. Since 2023, I have been an advisor to the Registry of the Supreme Court of the Slovak Republic.

Since 2023, I have been a deputy chairwoman of the Administrative Board of the University of Trnava (Slovakia). Between 2011 and 2017, I served on the Council of the Government of SR for Human Rights, National Minorities and Gender Equality.

In 2007, I was a member of a government cross-ministerial commission for the anti-discrimination law amendment. In connection with non-discrimination and equal treatment, I also worked on the amendments to further legal regulations – for example, the Slovak labor code, parental allowance act, court fees act, and civil litigious procedure rules. From 2009 to 2023, I successfully represented several persons affected by discrimination at work as part of strategic litigation on behalf of the ODZ. Concerning equal treatment, I have also held many educational events for courts (including the Supreme Court of SR and advisors to the Constitutional Court of SR), labor inspectorates, legal aid centers, ministries, public administrative bodies, non-government organizations, educational institutions, and companies. Between 2009 and 2016, I was a member of the European Network of Legal Experts in Gender Equality and Non-discrimination, which produces reports on implementing EU anti-discrimination directives for the European Commission. In 2023, I became a fellow associated with the Eisenhower Fellowships, focusing on the ways institutions and organizations may internally and externally put systemic equality and non-discrimination measures in place.

In the field of reproductive rights, I systematically concentrated on the violation of human rights of women and newborns in obstetric care for many years. Besides studying and collecting violation cases in Slovakia, I also dealt with the functioning of mechanisms for remedies that should follow violations. From 2015 to 2019, I provided expert consultations on that topic internationally, e.g., to the Council of Europe Commissioner for Human Rights, the UN Special Rapporteur on Violence against Women and Girls, its Causes and Consequences, and the World Health Organisation. These consultations became the basis of several documents, wherein the institutions mentioned above addressed the issue of providing obstetric care in terms of human rights violations more comprehensively and at an international level.

In January 2024, I started working for the legal firm Krivak & Co., where I primarily provide wide-ranging services to clients facing equal treatment issues. These services include, for example, drafting and revising agreements and internal regulations concerning their compliance with the principle of equal treatment; helping with the development and implementation of internal policies in the field of equality and inclusion, including policies preventing harassment, sexual harassment, and mobbing; assistance for employers in the fulfillment of requirements for equal pay, including requirements for the gender-neutral classification of occupations and requirements for transparency in pay; representation in anti-discrimination cases and other discrimination-related lawsuits; the internal investigation of the violation of non-discrimination including harassment and sexual harassment; and training on equality and non-discrimination. I also participate in counseling connected to the violation of rights in the provision of healthcare and human rights violations in other fields. My expertise also includes labor law.

My strengths are precision and consistency, strategic thinking, interdisciplinary, in-depth knowledge of my fields of specialization, excellent analytical and argumentation skills, accurate judgment, and the capacity to anticipate.

SPECIALIZATION

Anti-discrimination law (including equality and transparency in pay), labor law, health law (including reproductive rights), human rights, and international human rights protection mechanisms.
